Technically, you are right. But on the other hand, it was at a time when one had to wait at the most 6 months for AOS.
But, for people from India, on EB categories, the wait is not months, its in YEARS. So, its irrational to go by whats written there.
On the other hand: I think we must request USCIS to recognize this underlying problem with EB folks that are primarily from India. They must print an exception on the AP for India and exclude the wording "for emergency purpose only". I don't know if USCIS has the discretionary power to amend minor changes.

I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport. I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

I always cleaned my room, in India and here. What's wrong with that? Infosys founder Narayan Murthy cleans his own toilet (as per his own admission to a newspaper). I agree, FP does not have anything to do with namecheck. I never received my FP for 15 months but inbetween when I took infopass - it was confirmed that my name check was done
I was under the same impression that it was FP that triggered the name check. But this is what the lawyer told them that their names were struck in NC and that is why they never got FP and now that NC is over they received FP notices. The interesting part is that within 3 weeks of FP one person got a notice that his application has been sent to USCISlocal office for further processing which I assume means interview notice in few days.

Resolving the BEC problem is definitely one of IV's main goals. There is no way I will believe in DOL's claim of clearing all the back logs by Oct 2007.
IV has had a number of discussions with lawmakers and administrative officials, first to understand the issue and next to solve it. There are two ways to solve it. From our discussions, it has become clear that the lawmakers still view this as a temporary problem and are not willing to legislate on that behalf. Never the less all of them did agree that the efficiency of the BECs left a lot to be desired. So we were working a bi-partisan coalition of lawmakers who were willing to put pressure on DOL and USCIS on the need for efficiency and transparency.
All of this was before the crazy pace with which the Comprehensive Immigration Bill began to move. We do have to realize that this bill is a golden chance to have our provisions in place and we have less than 2 weeks to works on it. Frist wants either of the Immigration Bills to be passed before Apr 7th. If we do miss out on our goals in this bill and this bill gets passed, we will not be able to revisit our issues for a long time. So right now a lot of the attention is being given to it. This does not mean that BEC is forgotten. Hope you do understand.
I appreciate all that the more active members at IV are doing for BEC resolution. A sincere thank you.

Even I was thinking on the same lines and discussing with my friends. My son travel with us using PIO. But I was thinking to apply for the OCI.
Now the question is Pros and cons of OCI on PIO.
With OCI pro is
- one can live in India as long as he wants.
- Donot have to pay NRI fees in the school and colleges.
Cons -
Indian law will be applicable, means something happens US government won't do anything.
Rest of the NRI rules are applicable, no right to vote, limitation on kind of investments
Guys this is all I know, put more together so that everyone of us in the similar situation can make a decision.

We need to use the momentum of illegal issue to sneak in our provisions (which we already have with the advance degree provision, exception of spouses from cap,capture of unused visa numbers).
I think you are wrong in stating that I do not grasp the issue that AILA is only interested in illegal immigration issue and not in EB3 retrogression. I know that more than you can imagine, which is why I have been urging the forum to stop asking every one to fax the senators with requests to remove hard limits by country or even concurrent filing of I145 when visa numbers are not current. I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B�S.
Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator�s office we at least have some one who could explain the situation in a way that makes sense?
Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant�s issue. The reason for that is the issue that the U.S has is with ILLIGAL IMMIGRATION. The EB retrogression is really our problem, not some thing that is going to raise alarms in the senate. Which is why any amount of hue and cry is not going to change the situation? We should be glad that the advance degree provision, recapture of unused visa numbers and exemption of spouses from cap will make way for a few people and in the process clear up the backlog in EB3 category. If your education was equivalent to US Masters (16 years) at the time of filling labor, in your case more specifically MTech or MCA etc. (16 years education) from India, both equivalent to US masters then it�s a wrong denial.

Is there any way to know whether our case is already preadjudicated or not? Is it OK to call USCIS customer service number or taking an infopass appointment for just checking that?
I just want to have some peace of mind as USCIS is not require (hopefully :)) any documents from our side, if they already preadjudicated us.

If u guys are staying in an apt make sure u have both urs and ur wifes names on the letter box, since the EAD comes with a return service requested seal on it, if ur wifes name does not show up on the letter box there are chances that it would be returned to USCIS. this happened to me.

From some of the posts I found that some folks are concerned that it took so long to find and recognize talent from India at Oscars. Some felt Richard Attenborough's and Danny Boyle's movies got recognition whereas other Indian directors are not reaching the pinnacle.
Even though OSCAR is recognized globally, it is an American movie award (Yes there are exceptions in some categories of OSCAR -- such as Foreign Movies etc). So, because of that reason, normal Indian and other Foreign movies are not eligible to be considered for the OSCAR. It is the same reason why Hollywood movies are not getting awards at the National Film awards in India!!!
What I meant was, a particular movie has to meet certain eligibility criteria to be considered for the OSCARs. So, if a Bollywood movie directed by a Bollywood director meets those criteria, that movie can compete in the OSCARs.
So, In essence there is not that much discrimination at Hollywood - I found Hollywood as a place which embraces all cultures and beliefs. Hollywood is the real catalyst for the American melting pot theme.

Major Rules for consideration at Oscar are:
1. All eligible motion pictures, unless otherwise noted (see Paragraph 9, below), must be:
a. feature length (defined as over 40 minutes),
b. publicly exhibited by means of 35mm or 70mm film, or in a 24- or 48-frame progressive scan Digital Cinema format with a minimum projector resolution of 2048 by 1080 pixels, source image format conforming to SMPTE 428-1-2006 D-Cinema – Image Characteristics; image compression (if used) conforming to ISO/IEC 15444-1 (JPEG 2000), and image and sound file formats suitable for exhibition in commercial Digital Cinema sites,
c. for paid admission in a commercial motion picture theater in Los Angeles County,
d. for a run of at least seven consecutive days,
e. advertised and exploited during their Los Angeles run in a manner considered normal and customary to the industry, and
f. within the Awards year deadlines specified in Rule Three.
2. Films that, in any version, receive their first public exhibition or distribution in any manner other than as a theatrical motion picture release will not be eligible for Academy Awards in any category. (This includes broadcast and cable television as well as home video marketing and Internet transmission.) However, ten minutes or ten percent of the running time of a film, whichever is shorter, is allowed to be shown in a nontheatrical medium prior to the film's theatrical release.

“Slumdog Millionaire” would have excluded from OSCARs if it went straight to DVDs as per the initial assumption of its producers. Fox Searchlight rescued this movie and because of that it met all the rules above and included in the OSCAR competition.
Even though OSCAR is recognized globally, it is an American movie award (Yes there are exceptions in some categories of OSCAR -- such as Foreign Movies etc). So, because of that reason, normal Indian and other Foreign movies are not eligible to be considered for the OSCAR. It is the same reason why Hollywood movies are not getting awards at the National Film awards in India!!!
What I meant was, a particular movie has to meet certain eligibility criteria to be considered for the OSCARs. So, if a Bollywood movie directed by a Bollywood director meets those criteria, that movie can compete in the OSCARs.
So, In essence there is not that much discrimination at Hollywood - I found Hollywood as a place which embraces all cultures and beliefs. Hollywood is the real catalyst for the American melting pot theme.
