This is not for legal immigrants. It is clearly directed towards legalizing the illegals - who obviously would not leave US once they get a chance to enter.
Economy is in trouble so immigration will be on back-burner.
Still if Democrats chose to fix (really??) immigration, I think they would try to address concerns of Hispanic voters by legalize illegals and fixing family based immigration issues. This would help increase Hispanic votes, and support in 2010 elections. New Hispanic voters may make up for the non-Hispanic US votes they lose in the process.
If they address just legal immigration, it will anger both Hispanics, non-Hispanics groups and their votes in 2010 elections. So it's not a possibility.

Hello Everybody,
I know many of us are frustrated because of EAD delay. I am one of them and today I called up USCIS.
Here is the sequence.
1) 1 800 375 5283
2) 1,2,2,6,1 receipt notice# 1,3,4
3) you will have to wait for 10 to 15 minutes and one of the officer will come online for you.
4) at least they will give you information about your case ( mine is sent to some storage and they had to issue an expedite request to get it processed again. I am july 2 filer with notice dat of sept 8,2007 3 infopass apointments, 1 SR). the officer has access to look at the file and can give you appropriate information( they are not like regular service agents who will read what you see on USCIS.gov).
5) as of now they told me that I will information from USCIS in 2 weeks.

In light of the AC21 provision, this is pretty common - people change jobs using EAD and are then on AOS. Looks like the wording on AP was ignored when AC21 was being made into law. This is now biting some of the travelers.
Could the AP wording be changed using an administrative fix by USCIS/DOS rather than a legislative update?
AC21 is nothing to do with AP. In AC21, you are changing the job WITHIN US, not leaving US. There is some securty related reason, for requiring one must not leave USA when AOS is pending. AP is for a short emergency travel during AOS. Yes..it will be a pain if AOS takes many years, particularly travel issues.

Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.

I am trying to efile an AP application right now. It always says following lines at the end of 131 form step.
Note:There are still suggested fields not completed on the following forms:
I really do not know as to why its doing so. I have checked several times that I have not left any field blank that is required. Did somebosy also see the same issue ?

You are missing the point. I do NOT think I am SPECIAL. I have an MBA from a US reputed Univ. plus 5 years of experience... I do assessment of their existing IT systems and give recommendations.
My logic is differrent.. This is valid for US born people too. WHY would a company pay $180 an hour to a consulting Co. for the same skill-sets.... however, when you go to them directly they will just pay you $60-$70.
if the difference is really that big than seriously i fail to understand it, they might be accounting for lot of other things like travel expense and other benefits that they might be providing but if the spread is as big as you are saying then it surely does not make sense. if this has anything to do with SOX then consulting company might be guaranteeing lot of things and might have legal liabilities if that is not the case then it is unexplainable.
although i strongly refute the possibility that hiring managers are eating money because just like any beauracracy few guys cant keep benefiting without sharing the benefits and no descent company will tolerate that kind of culture there could be isolated instances but when they are found out they are very severely punished and their life becomes that of a dog running from here to there because in most industries if you are working for a certain domain people know each other and reputation travels faster than light especially bad reputation.

I and my family feel immensely proud that we are able to live in this country of freedom governed by a great leader like you.
Mr President you are the symbol of hope not only for the citizens of USA but also for all of the immigrant community. You have raised our hopes that we will also be able to become a citizen of this great country soon. Your selection as the Nobel Peace Prize winner has strengthen this hope further. Sir, Please do not belie our hopes.
Please revamp the current immigration rules and provide immidiate attention to the immigration reform. Sir, we all are looking up to you.

Till 2007 that was how it was being interpretted and then suddenly DOS realised it should be by category and not by country of chargebility.
The earlier Eb1 ROW>Eb2 ROW>Eb3 ROW spillover is called vertical spillover
