I admire IV and all its administrators, because grassroots efforts are never easy. IV along with its admins, has definitely had done a lot of hard work to reach to this stage.
At the same time, I would appreciate all senior members, and whoever reading this to keep the discussions more as a follow-up on action items.
Irrespective of statistics and the decision-makings of USCIS, it is very evident that some form of law changes must occur to clean-up this GC process.

I think we should start a Employer Hall of shame and nominate employers who are either cheating the employees or the Immigration system.

No, they count MS REQUIREMENT FOR POSITION as 4 yrs toward total SVP time according to that doc link I posted. These 4 yrs include 2 for BS plus 2 additional for MS. It is how they count. Nobody knows or cares how long it actually took you to get MS.

Guys if the employer's lawyer is not giving you information regarding the I140 and you are going behind their back for this information is it really going to help you with portability? It looks like they are just trying to make life miserable for you and what guarantee is there that they will not revoke your I140? I140 portability does not work if they revoke your I 140.

Thanks Almond... your post summarizes exactly how ppl in my position feel. one of my frds did MBA from top 20 B-school but could not change to a new job in management career becoz his I-140 approved but did not file for I-485 yet and worse yet he crossed 6 year H1b. now he is also living on 3 year h-1b extensions with approved I-140. when he was venting his frustration like me, one a$$hole (GC holder) suggested he move back to his home country. funny thing was this a$$hole got her GC becoz she married some bakra who already applied for GC. within 6 months after she arrived in US, her huby got them GCs. This dumb wothless piece of $hit doesnt know how hard (impossible ?) to get GC in this lifetime becoz she got it in 6 months :mad: .

I feel terrible for your friend because he has such education and is stuck like this. It feels like you're wasting the best years of your life just waiting. There is nothing that I or anyone can tell you or your friend to make you feel better but please listen to me and learn from my mistake, and tell your friend, too: DON'T WASTE THIS TIME. If you need to volunteer somewhere to use skills that you have that you are not allowed to use on your present job, DO IT. Or if you can take classes to learn new skills, DO IT. Find a way to be more than what you are now so that when this is over you are not just "floridasun, man stuck in the same job for 10 years" When you finally get out of this hell hole and someone looks at your resume and says, what, you did this for how long!? Then you can say, well I had a special situation, however, sir, look at these other things I have done.

thanks villamonte6100 to bring this issue up to IV notice. btw in which state you had this problem?
I know few states have their own set of rules for license renewal or for first time license issue, but not sure whether entire US states are asking for more immigration related documents during the renewal and that too taking 9wks verification as you said, nt sure whether it is true...
may be IV core team should open a link, should ask everyone to post if they had similar experience recently in their states so that we can find out more fact abt this issue.

Does any of you know what rights for maternity leave has a pregnant H1B visa holder? I want to stay home next year for 3 months to take care of my baby, then start working again.
From what I know I can only have the 6 weeks of short term disability.
The Maternity Act does not apply in my case because the company I'm working for has under 50 employees.
I asked my lawyer if I can take any unpaid leave without loosing my H1B status and her answer was that I can change my visa to H4 or become a part time employee for a while. I do not like any of this options because I'm in my I140 stage with my green card and I do not want to lose it at this stage, after waiting for years to get my labor cert approval.
Your answer would be appreciated.

I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport. 1) I would go with travelers cheq's like "srinithati" mentioned. That way it wont be a problem asking someone to bring along with them when travelling from India to USA
2) If you still have any money on your NRI account , check to see if its re-patriatable type. If you what-ever money you have on you URI account ( except the minimum balance you might need to keep you can convert back to dollars.
3) May eb we should think about Hawala ( India -> USA ) due to these conversion rates

the problem currently is that the system is full of lies. when you came here did you know that only 10,000 indians, by LAW, are allowed to get employment GCs per year? No. They gave you all that green grass story about how your math skills are needed here. how they don't like to study math here (and why not? all the books I studied math from were by American profs. ).
They don't want to study math because it doesn't pay. Lawyers, doctors and MBAs (bullshitters) make money here. someone has to do the work. that's where the illegal mexican and WE come in.
Let them make whatever rules they want. If the rules are bad people will stop coming here. But BEFORE a company makes an offer for an H1 employee, it should provide all the fineprint. How long the queues are, how many people get added per year, the expected time for GC processing, the fact that changing employers is almost impossible.
