    EB3 (I) have been hit hard there should be some effort to get the ball rolling, and I fail to understand why EB2 (I) should get offensive about this effort. EB2 is going to get what they get anyway, but EB3 guys might get somewhere if this kind of concentrated effort is made.

    I beleive EB2 will not be affected by this effort, if we draw enough attention we all EBs will get our GC sooner than later.

    Thanks for your feedback. We dont have valid H1B stamp on the passport although we have a valid H1B approval. My wife needs to go for stamping.
    My question is, Can I enter thru AP after a 4 week period whereas my wife can apply for a H1B visa at US consulate and enter using the stamp on her passport. I would be using H1B and working for GC sponsoring employer and wont use EAD during this period.


    If you use AP to enter you will not be in H1B status but you will get Parolee status. If you enter using a valid h1b stamp, you will get into h1 status. Your spouse cannot get h4 stamp based on your parolee status but can get h1 stamp based on her own h1 petition.

    It is also possible to be in AP status and use the H1 petition to continue working for the h1b employer. EAD is just a work authorization and is not mandatory in this case. Check this link for more information:

    Has anyone seen the statue of Mahatma Gandhi at the MLK memorial at Atlanta as well as a whole section devoted to Gandhi in the museum.

    Huh? I was trying to convey that Gandhi's philosophy of passive resistance was so awesome that it had a strong impact on even a "little" person like me, growing up in Apartheid South Africa. And frankly, nations are made up of more "little" people than heroes ;)

    your posts should seriously offend me as I am from A.P but again, are you really worth that I should be upset about your rants.. I don't think so... your title suggests it all.. you acknowledge you are uncontrolled...

    coming to your question below - I haven't applied for GC but I plan to soon. and common sense tells me that unless all the ones infront of me get theirs, I should wait for a loooong time and that is enough motivation for me to go to DC rally, work on IV action items, join the state chapter and most important CONTRIBUTE so that IV has the funds that will eventually help me. july 2007 fiasco didn't help me to get my EAD but that doens't mean I have to spill my frustation in bad taste in an educated forum with stupid handle..

    if you are NOT planning to apply for GC and go back to your home country - no body is stopping you. you are FREE to move back. H4 dependents can't work and there is no surprize there. thats the rule they had in place from day 1. if you don't like it - do something about it and let us know what you are doing - we might actually support you.

    if you think ranting in public forums and showing your frustation on one community is "showing courage".... well.. I hope you get well soon...

I just started with a simple question "WHATS THE MOTIVATION FOR CONTRIBUTION(MONEY AS WELL AS TIME) FOR PEOPLE WHO HAVEN'T APPLIED FOR GC " !! Was that offensive ?     I first immigrated to Canada, got my citizenship and then came here to the US and am languishing in this stupid GC queue for the past 7 years..

    Inspite of all the freedom to go back to Canada, I would now, rather move back to India than any other place...

    Forget the little hardships in India..what matters is that India's IT economy is booming...booming like probably no where else in the world!

    Why not, go back there, repay the country that gave me all the skills in the first place, and at the same time participate in that booming economy?

    everyone loves their money....but think if nothing will change how much of your loved money you will spend every year to renew EAD and AP...just do the calculations and you will think that it is worth to part some of our loved money..


    No offense Nik..but dude my company actually pays for it..so no loss..in renewing EAD..but unfortunatly my EAD is not yet approved..so I am not yet there.....SAD

    I only meant if you have the native country license already or if you can get it remotely. Leaving the US for the express purpose of getting you native country license would be an overkill...as you would agree :)

    Unfortunately, I can't leave the US for the following reasons
    a) AOS pending
    b) H1 expiring soon
    c) Won't get any vacation time as just joined a new job.

    In times like these, we should look at the employment generation capabilities of the skilled immigrants. The argument that skilled labor would take US jobs and increase unemployment does not hold as those with 5+ years experience in the US in a skilled position are very likely to start new business, have career in new fields at managerial positions, buy a house, etc which will in itself be a huge stimulus to the economy.

    The same cannot be said about unskilled labor though.

    How are you sure that the "sneaking in" of our provisions with the 'undocument workers' provisions is going to alleviate our plight?.

    Note that the staff to support this overhaul is not going to increase overnight. Consider this - 100 people (just a 'supposition' - this is not a hard number) are working on 500,000 applications today; With the passage of provisions for 'undocumented workers', the same staff of 100 is going to work on 11 million 500,000 applications, atleast for the next 1-2 years. Do you understand the mess that this will create? It will be a similar mess as the 'Labor backlog center', where the applications of 2003 are still waiting for their certifications.

    Although I agree that we should work towards supporting the current provisions already in the bill, I still feel that issues such as 'I-485 application without PD current' and 'removal of hard country quota' are important, in order to ensure short-term reliefs. These provisions may not help your specific case, however it may help 1000s of other cases.

    Just my opinion from the limited knowledge that I have of, how UCSIS operates!!!

    I understand that you guys have done a lot with limited resources, but trying to isolate yourself from the issue of illegal immigrants issue is not going to help us either. We need to use the momentum of illegal issue to sneak in our provisions (which we already have with the advance degree provision, exception of spouses from cap,capture of unused visa numbers).

    I think you are wrong in stating that I do not grasp the issue that AILA is only interested in illegal immigration issue and not in EB3 retrogression. I know that more than you can imagine, which is why I have been urging the forum to stop asking every one to fax the senators with requests to remove hard limits by country or even concurrent filing of I145 when visa numbers are not current. I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B’S.

    Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator’s office we at least have some one who could explain the situation in a way that makes sense?

    Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant’s issue. The reason for that is the issue that the U.S has is with ILLIGAL IMMIGRATION. The EB retrogression is really our problem, not some thing that is going to raise alarms in the senate. Which is why any amount of hue and cry is not going to change the situation? We should be glad that the advance degree provision, recapture of unused visa numbers and exemption of spouses from cap will make way for a few people and in the process clear up the backlog in EB3 category. We need to back this unanimously instead of trying to introduce new amendments in the last minute. No offence but

    When we are dealing with DOJ, why do we need significant volume ?
    When dealing with representatives ( lawmakers ) we need large volume to make any impact.

    Here we are talking about DOJ, who would make a decision based on the legal validity of our request.

    Please correct me if I am wrong.

    Guys,

    I am also close to situation 3.a but I changed my GC sponsered employer and working for other good and stable company using AC21.

    I would like to start a company and do a side business.

    What you recommend - registering it on my is good idea or on spouse's name?

    If I register it on my name and generate a profit - is it going to impact my 485 as I already invokded AC21? (again I will be working in simialr job as a FT)

    Any sugessions would be great help.

    If you are on 3a, you have neither used AC21 nor have you left your full time job (FT job that aligns with your LC). On EAD, you can do any number of jobs (ex: you can even work 2 part time jobs totally unrelated to your LC requirements ofcourse as long as you continue to be with your GC employer). Using this rationale, you should be fine starting a business and making profit in the part time.

    In fact even those who were in 3 b were able to get their GC after an interview (Search for posts by the user "unitednations"). But, it's risky and best avoided.

    Personally, I want to get into 3 a, but my 140 is still pending. I plan to approach my company to switch me to EAD as soon as my 140 gets approved.

    Ronhia, I appreciate your comments. It needs conviction, dedication and consistent efforts to make such accomplishments. Moreover it also demonstrates the character of a person, who can motivate and inspire other kids in a positive way.. especially in an environment full of negative distractions.

    If spelling bee competition is considered merely as just cramming the dictionary, as you rightly said we need to really spend some time looking beyond your own shell.

    When you open a magazine, for sure, you tend to come across pages that may not be of interest to you. We skip the page and move on rather whining with words (yucky, stupid, senseless) that are inappropriate.

    "Winning a national competition is not so great"... again it depends on what is so great to you !!!..

    Roy, 14, an eighth-grader at Abington Heights Middle School, Pennsylvania, said she knew as soon as she heard "cymotrichous" that she'd get the word right and win the championship Thursday night.

    "My heart started pounding, I guess," she said. "I couldn't believe it. . It's just amazing. It's hard to put into words."

    It was Roy's third trip to the national spelling bee, and she had credited her past experience with keeping her calm and relaxed heading into the finals. She tied for 12th place in 2009 and 20th place in 2010.

    Roy speaks Bengali and every summer travels to India to visit family. She hopes to pursue a career in international relations.

    Roy is the ninth Indian-American in the last 13 years, a run that began when Nupur Lala captured the crown in 1999 and was later featured in the documentary "Spellbound."

    I am really shocked to see that several of us in our community are still ignorant about the magnamity of the Green card situation.

    Just this morning, I was talking to one my friend urging him to participate actively in the IV efforts and the answer I got was, "What for? , now that my I-485 is filed, I should get my greencard in a year." His PD is April 2006.

    I am suprprised if IV is working towards abiltiy to file 485 and hard country limit...Just want to know how IV is working towards these 2 items...
    If any of these two wont show out in coming bill,..then I would say goodbye to IV..because all other items in bill were there without IV;s interaction....

    Can somebody calrify if these options will anyway include in this bill..by means of ammendements...

    We have been fighting very hard to introduce a number of amendments including the ability to file I-485 and also to remove the country limit. We have spoken to a number of senators in this regard.

    While we have no guarantees that they will be introduced, one thing I can guarantee, we will fight as hard as we possibly could.
