Yes. That is exactly what happens. Everytime a cut-off date advances in a certain category, a sweep is conducted of all previously submitted I-485s, and either continue their processing, or if processed far enough, approve it. If a category retrogresses, processing on the case may or may not stop, but APPROVAL IS IMPOSSIBLE if the PD is before the cut-off date.

Processing was completed on my case over a year ago, but I could not be approved until Nov 2006, because of my PD.
If, god forbid, I am not approved in November, and EB3 retrogresses back 2 months, I will once again be stalled.

The reason I suggested sending in our credentials is beacuse the key in reverse brain drain is also "brain" along with "drain".
If we send in copies of our credentials (respectfully, in a nice package ) along with a stopper it will show them what they are going to loose.
Even to hard core right wingers it will show them that even if they neglect the human factor (caused by the in ordinately long delays) they cannot neglect the intellectual factor..

The issue at hand is not to "prove" if you are educationally qualified rather long delays in legal employment based immigration. So sending copies of degree certificates may not convey our message.
Stopper is a good idea because it weaves two ideas very effectively:
- Stop American jobs from off-shoring : use a stopper
- Stop reverse brain "drain" from America to keep America competitive : use stopper
This concept of reverse brain drain is well documented by the recent Kauffman foundation study http://www.kauffman.org/items.cfm?itemID=906
where they mention that 100K high skilled immigrants have left US to go back to India, China and other countries.

The Schedule A Workers category has become oversubscribed for November and a cut-off date established to hold number use within the 50,000 numerical limit. It is expected that demand will bring allocations up to the program limit during November. Once the limit is reached no further allocations will be possible, and the category listing will be removed from future cut-off date tables.
A PD for Schedule A category is for those people filing under EB2 with exceptional skills in arts and sciences . We had a post recently. Nurses and PT's do not have PD's as they do not have to file Labor Cert in the first place.

If you had received a denial of your application for example not having the same designation/ different salary/different location etc... please contact and we would like to assist. This would also help us try solve the larger issue of restrictions on applicants during their greencard journey where they are bound with employers, salary, designation, narrow occupation field etc.

Dear snehaledu, You raise a good point. Am I IV policeman? The answer is NO. Guess, it is the responsibility of all the members to police themselves. And I saw that it was not happening here, thus my question about the relevance of this thread.
I understood that IV is working on behalf of green card backlog applicants and the intended purpose of IV forums is to provide support for legislative effort. Please help me understand how this thread about $1 is Rs. 44 or whether $1 is Rs. 46, helping in achieving IV goals? I am just scratching my head in an attempt to figure that out. There are many other forums on the internet where you could discuss anything under the sun. There are many other forums where you could discuss everything about exchange rate variations. Why don�t you go and discuss it over in those forums?
Also, we all should be considerate towards all other members of IV. It was my understanding that IV membership includes people from all over the world. I gave this idea last time when we were sending flowers to USCIS. Remeber the time when Gandhi decided to burn the official immigration document publically when he was in South Africa. I am not saying that we should burn our original I-797 etc, but lets symbolically burn the photo copies of our legal documents in form of a demonstration in front of media. This way we would be able to get media attention, and bring awareness as to how legal immigrants are treated in this country by the govt department responsible for immigration.
It would be better if this types of demonstration tale place in front of local USCIS offices.

Hello,
i am lawful permanent resident. I want to bring my parents here permanently. I got nobody in India to take care of my parents.
When i was small, my parents took care of me. When i need them, they are their for me.
Now my parents need me. But i am not their for them. I feel very guilty and sad. I want to bring my parents in US. So i can take care of them.
How can i bring my parents permanently.
I know, i can bring them after i get citizenship, that is too long wait.
i just want to bring them now. So they can have good life with me. Anybody know, how can i bring them in US soon.
i saw some petition signed by many Indians for this request. Can somebody please go forward with this.
Current president will understand our request and help us. He is very nice and kind person. He loves family and his mother in law lives with his family. He knows values of grand parents.
Indians live with family, that makes Indian family stronger and less divorce. And Indian kids are well taken care by grand parents. So they are well behaved and best kids.
We need this permission. Please work together and get this permission.
I read this in a website. Is this possible? I want to explore all possible steps.

My interpretation: the vote was not on Cornyn's amendment; in response to a Point of Order raised, there was a motion to waive the Budget Act for Cornyn's amendment (the Budget Act requires 60 "Yes" votes to bring to the floor amendments to appropriation bills); if 60 senators had voted "Yes" (and agreed to waive the Budget Act requirement for Cornyn's amendment), then a vote on the actual amendment would only have required a simple majority. But because only 55 voted "Yes", the amendment failed to obtain the waiver; it was out of order because it did not qualify as an amendment to this bill.
Because 40 Dems voted no on the waiver does not mean they are opposed to the amendment; they just did not want to vote on this amendment on this bill.

Lets see how much of this bill actually makes it out. As far as I can see, I am prefectly fine with refiling my application under this new category. The hell with EB based green cards.

If we reapply under this section, we will be competing with the massive illegal-to-AOS guys based on our Receipt date for adjudication.
If we get recapture provision in this bill ( most likely ), that would be our best bet.
